WhatsApp's 2026 AI chatbot policy: what's allowed for businesses

Meta changed WhatsApp's business terms in 2026 to keep general-purpose AI assistants off the platform. Here is what the rule says, who it affects, what is still allowed, and how to keep your AI chatbot compliant.

WhatsApp’s 2026 AI chatbot policy does not ban AI chatbots for businesses. Since January 15, 2026, WhatsApp’s Business Solution Terms stop “AI Providers” from using the WhatsApp Business Platform to offer general-purpose AI assistants, where the AI itself is the main product, except for users in markets where Meta is legally required to allow it. If you use AI to serve your own customers, such as answering product questions, booking appointments or tracking orders, that use is still allowed, as long as you follow the normal messaging rules.

Below we explain what changed, who it affects, what you can and cannot do, the data and pricing rules that come with it, and a checklist to keep your WhatsApp AI chatbot compliant.

What changed in WhatsApp’s AI policy in 2026?

Three updates matter for anyone running AI on WhatsApp this year.

The Business Solution Terms page currently shows a last-modified date of March 6, 2026, and the WhatsApp Business Messaging Policy was last updated on September 23, 2026. Both are linked in the sources below.

Who is an “AI Provider” under the new terms?

The terms define AI Providers as providers and developers of artificial intelligence or machine learning technologies, including large language models, generative AI platforms, general-purpose AI assistants and similar technologies, as Meta determines.

The key test is whether the AI is the primary functionality being offered, or whether it is incidental or ancillary to something else. Meta decides which side a use falls on. In practice:

  • A company whose WhatsApp number exists so people can chat with its general-purpose assistant about anything is offering AI as the primary product. That is what the terms restrict.
  • A store, clinic, airline or bank that uses AI to answer questions about its own products and services is using AI in support of its business. The AI is a means to deliver customer service, not the product itself.

What is still allowed for businesses?

If your AI is there to serve your customers, these uses remain within the rules:

  • Answering questions about your products, services, prices, policies and opening hours
  • Order tracking, returns, delivery changes and account questions
  • Booking, rescheduling and cancelling appointments or reservations
  • Qualifying leads and passing them to sales
  • Collecting structured details, such as a form, an address or a photo of a damaged item
  • Summarizing or translating chats for your agents
  • Hiring an AI company as a service provider to run your bot, as the terms allow businesses to retain an AI Provider as a Third Party Service Provider

What is not allowed?

  • Offering a general-purpose AI assistant as your product on the WhatsApp Business Platform, outside the markets where Meta must permit it
  • Training AI models on WhatsApp business data. The terms prohibit letting Business Solution Data, including anonymized, aggregated or derived forms, be used to create, develop, train or improve AI or machine learning models. The one exception is fine-tuning a model for your own exclusive use, without using the data to build or improve any other model.
  • Automation with no way out. The Business Messaging Policy requires prompt, clear and direct escalation paths whenever you automate replies.
  • Collecting sensitive identifiers in chat, such as full card numbers, financial account numbers or ID numbers
  • Using AI to message people who did not opt in, or to start conversations without an approved template

Meta can terminate an account and revoke access if it reasonably determines that the AI restrictions were breached, so it is worth checking where your use case sits before you scale it. The exception: EEA and Brazil

The terms allow these AI technologies to be made available to WhatsApp users whose phone numbers are registered with a European Economic Area or Brazil country code, in line with where Meta is legally required to permit this use.

Meta also introduced an AI Providers pricing policy, effective February 16, 2026, under which AI Providers pay for each non-template message they deliver in markets where Meta must support them. Meta’s page lists how this changed over the year: Italy from February 16, Brazil and the other EEA countries from March 11, and, after an update on May 12, 2026, Brazil remains the listed market. Ordinary businesses are not charged under this policy; they follow the standard rate card.

The rules every AI chatbot on WhatsApp must follow

The AI-specific terms sit on top of the normal WhatsApp Business Platform rules. Your bot must respect all of them.

Stay inside the 24-hour customer service window

Your AI can reply freely only within 24 hours of the customer’s last message. Outside the customer service window, it can only send approved template messages, and only to people who opted in.

Provide a real escalation path

The Business Messaging Policy names acceptable paths: an in-chat transfer to a human agent, a phone number, email, web support on your site, in-store visits or a support form. An in-chat handover with full history is the smoothest for the customer.

Do not mislead

The policy says businesses must not confuse, deceive or mislead people, or impersonate another business. Keep your AI’s persona honest about who it represents, and keep its answers grounded in your actual policies, since an invented refund rule is still your business’s promise.

Respect privacy and data rules

You need the notices and consents required by law and a published privacy policy. Do not use data obtained from WhatsApp about a person for anything other than supporting your messaging with that person, and do not forward one customer’s chat to another.

What does an AI chatbot cost on WhatsApp now?

For businesses that are not AI Providers, AI replies are priced like any other message. Since October 1, 2026:

  • Free-form replies inside the customer service window are service messages. Each business phone number gets 1,000 free per month (no rollover); after that, Meta charges the service rate for the recipient’s market.
  • Messages in a free entry point window, opened when you reply to someone who came from a Click-to-WhatsApp ad, are not charged. Meta says this window may remain open for up to 7 days.
  • Messages sent through Meta’s own Meta Business Agent are billed differently, through a per-token charge, and remain charged even in a free entry point window.

Example: an AI assistant that sends 3,000 replies a month to customers in Mexico from one number pays for 2,000 of them. At the October 2026 service rate of $0.0085, that is about $17 in Meta fees, plus whatever your AI model costs. Compliance checklist for your WhatsApp AI chatbot

  1. Purpose: the AI answers questions about your own business, not general questions about anything.
  2. Scope: instructions restrict the bot to your topics and tell it to decline the rest politely.
  3. Grounding: answers come from your documents and systems, not from the model’s memory.
  4. Handover: customers can reach a person, and the bot offers it when it cannot help.
  5. Window and templates: proactive messages use approved templates and go only to opted-in contacts.
  6. Data: no full card or ID numbers in chat; WhatsApp data is not used to train shared models.
  7. Transparency: the bot is honest about which business it represents.
  8. Review: someone reads a sample of AI conversations every week and fixes wrong answers.

A sample opening message that sets the right expectations:

Hi, I’m the virtual assistant for [Business]. I can help with orders, delivery, returns and bookings. Type “agent” at any time to talk to our team.

And a polite scope refusal:

I can only help with questions about [Business] orders and services. For anything else, I’m not the right assistant, but I’m happy to help with your order or connect you with our team.
