Cancellation Policy
Terms of use for MonoChat services, consumer rights, and cancellation rules prepared in accordance with Turkish legislation.
General Terms
This page regulates the terms of use, consumer rights, withdrawal, cancellation and refund conditions for services provided by Bordo Bilişim Ticaret A.Ş. ("MonoChat", "Company", "we"). These terms are prepared within the framework of the Consumer Protection Law No. 6502 and relevant legislation.
Definitions
Terms used in this agreement shall be used in the meaning defined below:
- • SELLER: Bordo Bilişim Ticaret A.Ş.
- • BUYER/CONSUMER: Natural or legal person purchasing MonoChat services
- • SITE: www.monochat.ai website
- • SERVICE: MonoChat multi-channel communication platform service
- • AGREEMENT: These terms of use and service agreement
- • KVKK: Personal Data Protection Law No. 6698
Service Definition and Features
MonoChat is a SaaS (Software as a Service) that enables businesses to communicate with their customers via WhatsApp Business, Instagram, Facebook Messenger and other platforms:
- • Multi-channel messaging platform (WhatsApp, Instagram, Facebook, Telegram, WebChat)
- • AI-powered chatbot services
- • Analysis and reporting tools
- • CRM and existing system integrations
- • 24/7 technical support service
- • Data security and KVKK compliant infrastructure
Payment Terms
Service fees and payment conditions are regulated as follows:
- • Service is provided with a monthly subscription system
- • Payments must be made in advance, before the service begins
- • Payment options available via credit card, bank transfer/EFT
- • Prices are shown including VAT
- • Service may be suspended if payment is not made
- • Daily 0.1% late payment interest may be applied on delayed payments
Unauthorized Credit Card Use
In case of purchases made with unauthorized use of credit card:
- • If the bank/financial institution does not make payment
- • MonoChat has the right to stop providing service
- • Product/service must be returned within 3 days
- • Return shipping costs belong to the SELLER
- • Immediate notification will be made about the matter
Force Majeure and Service Interruptions
If the service cannot be delivered within the service period due to unforeseen reasons:
- • The situation will be immediately notified to the BUYER
- • BUYER's options: Order cancellation, Service change, Delivery postponement
- • Force majeure situations: Natural disasters, war, terrorism, internet outages
- • SLA guarantees apply for technical infrastructure outages
- • Outage period is added to service period
Right of Withdrawal
Your right of withdrawal pursuant to Consumer Protection Law No. 6502:
- • There is a 14-day right of withdrawal period
- • The period starts from the date the service contract is established
- • You can make the withdrawal notification to hello@monochat.ai
- • You can exercise your right of withdrawal without giving any reason
- • The commencement of service performance does not affect the right of withdrawal
Exceptions to Right of Withdrawal
The right of withdrawal cannot be used in the following cases:
- • Services that have commenced with consumer consent (provided that the entire service is fulfilled)
- • Products or services prepared specifically for a person
- • Services that are not suitable for return due to their nature
- • Digital content and software services (after use has started)
- • Ongoing services in subscription system (in case of monthly billing)
Refund Process
The refund process in case the right of withdrawal is exercised:
- • SELLER refunds the total amount within 10 days
- • Refund is made through the same payment method
- • Bank processes for credit card payments may take 2-8 weeks
- • Wire transfer/EFT payments are refunded within 3-5 business days
- • Refund documents are sent via email
Cancellation Terms
Service cancellation procedures and conditions:
- • Can be cancelled with 30 days advance notice
- • Service is provided until the end of the ongoing service period
- • Cancellation notification must be made in writing
- • Automatic renewal is cancelled
- • Your data export right is protected for 90 days
- • No cancellation fee is charged
Data Retention and Destruction
Data processing after service cancellation:
- • Account data is retained for 90 days
- • You can request data export during this period
- • Data with legal retention obligation is protected
- • Personal data is processed in accordance with KVKK
- • Data is deleted upon request
- • You can request destruction certificate
Liability and Compensation
Responsibilities of parties and compensation conditions:
- • SELLER is responsible for direct damages resulting from service interruptions
- • Indirect damages (loss of profit, loss of business, etc.) are excluded
- • Maximum compensation amount is the monthly subscription fee
- • Damages arising from BUYER providing incorrect information are excluded
- • Interruptions on third-party platforms are not the responsibility of SELLER
Dispute Resolution
Procedures to be followed in case of dispute:
- • Solution is primarily sought through negotiation
- • Consumer Arbitration Committees can be applied to for consumer issues
- • Istanbul Anatolian Courthouse courts have jurisdiction
- • Turkish Law applies
- • Online dispute resolution platforms can be used
Changes in Terms
Changes to be made in these terms:
- • Notified 30 days in advance via email
- • Published on the website
- • Ongoing services continue with current terms
- • You have the right to cancel if you do not accept new terms
- • Use after the change date is considered acceptance
